Who we are

Elements AI is a brand of Creative Elements LLC, a Colorado registered limited liability company. In this policy, "we", "us", and "our" refer to Creative Elements LLC.

Scope

This policy explains what personal information we collect when you visit elementsai.net, contact us, or engage our services, and how we use and protect that information. It applies to information collected through this website and our business communications.

Information we collect

We collect the following categories of personal information:

  • Information you give us directly through our contact form or by emailing or calling: your name, email address, phone number (if provided), the service you're interested in, and the contents of your message.
  • Information collected automatically by our hosting provider: standard web server logs (IP address, browser user agent, referring URL, timestamps) used for security, troubleshooting, and abuse prevention.
  • Spam-protection signals from Cloudflare Turnstile when you submit the contact form: Turnstile assesses whether the request is automated and returns a pass/fail token. We rely on this token; we do not see Cloudflare's underlying signals.
  • Analytics (if enabled): we may use privacy-respecting analytics (such as Google Analytics 4) to understand aggregate site usage. Where enabled, we configure IP anonymization and do not use analytics for advertising.

We do not set advertising cookies, sell personal data, share personal data for cross-context behavioral advertising, or use your information for automated profiling that produces legal or similarly significant effects.

How we use your information

  • To respond to your inquiry and discuss potential work together.
  • To provide, schedule, and deliver services you've requested.
  • To send service-related communications (project updates, invoices, scheduling).
  • To maintain the security and integrity of our website and prevent abuse.

  • Bot and spam protection services - to protect the contact form from automated abuse.
  • Analytics providers - where enabled, for aggregate site usage statistics only.
  • Scheduling and booking platforms - if you book a consultation through a link we provide.
  • Embedded mapping services - to display location maps on the Site.
  • Professional service providers - such as accountants, lawyers, or other advisors, where reasonably necessary.

These third parties act as our processors or independent controllers under their own terms. We do not sell your personal information and we do not share it for cross-context behavioral advertising.

Embedded third-party content

Some pages on the Site embed content from third parties that loads directly in your browser. When you interact with these embeds, the third party may receive your IP address and other technical information under its own privacy policy:

How long we keep it

We keep contact form submissions and email correspondence for as long as we have an active or potential client relationship, plus a reasonable period afterward for record-keeping, tax, and legal compliance purposes (typically up to seven years for financial records). Server logs are typically retained for 30-90 days. You may request earlier deletion as described below.

Your privacy rights

Depending on where you live, you may have the following rights regarding your personal information. Colorado residents have these rights under the Colorado Privacy Act (CPA); residents of California, Virginia, Connecticut, Utah, and several other states have similar rights under their state laws.

  • Right to know / access what personal information we hold about you.
  • Right to correct inaccurate personal information.
  • Right to delete your personal information.
  • Right to data portability - receive a copy of your personal information in a portable format.
  • Right to opt out of the sale of personal information, targeted advertising, and certain profiling. Note: we do not engage in any of these activities.
  • Right to non-discrimination for exercising any of these rights.

Authorized agents: Colorado and California residents may use an authorized agent to make a request on their behalf. We will require written proof of authorization.

Appeals (Colorado residents): If we deny your request, you may appeal by replying to our denial email. We will respond to appeals within 45 days. If your appeal is denied, you may contact the Colorado Attorney General at coag.gov.

Cookies and tracking technologies

We use only essential cookies needed for the site to function and, where enabled, a single first-party analytics cookie. We do not use advertising cookies or third-party tracking pixels. You can control cookies through your browser settings.

Do Not Track and Global Privacy Control

We honor the Global Privacy Control (GPC) signal as an opt-out of any sale or sharing of personal information. Because we do not sell or share personal information for cross-context behavioral advertising, GPC has no effect on our default practices, but we treat the signal as a valid opt-out request where applicable.

Children's privacy

Our website and services are intended for adults and businesses. We do not knowingly collect personal information from children under 13 (or under 16, where applicable). If you believe a child has provided us information, please contact us and we will delete it.

Security

We use industry-standard safeguards to protect your information, including HTTPS encryption, server-side spam filtering, and access controls. No system is perfectly secure; we cannot guarantee absolute security but we work to minimize risk.

Email communications

If we email you, every commercial email will identify Creative Elements LLC, include our mailing address (834F S Perry Street PMB 1436, Castle Rock, CO 80104), and provide a clear way to opt out, in compliance with the federal CAN-SPAM Act. Transactional emails (such as project updates and invoices) are not subject to the opt-out requirement.

International users

Our services are operated from the United States. If you access this site from outside the U.S., your information will be transferred to and processed in the U.S. We do not market our services to individuals in the European Economic Area or the United Kingdom and do not knowingly process EEA/UK personal data subject to GDPR.

Changes to this policy

If we make material changes to this policy, we will update the "Last updated" date above and, where appropriate, notify you by email or a prominent notice on the site.
